These Terms and Conditions of Sale apply to purchases made directly through tokulondon.com. The website and online store are operated by Girlevik Limited trading as Toku LONDON.

Please read these terms before placing an order. They explain who we are, how orders are formed, how we supply goods and what to do if there is a problem. These terms do not exclude or restrict any consumer right that cannot lawfully be excluded or restricted.

Our registered office is our legal company address. Orders are fulfilled and customer returns are handled from our operational location in Godalming, Surrey, as stated in our shipping and returns policies.

  1. SCOPE OF THESE TERMS

These terms apply to consumer purchases made on tokulondon.com. Separate written terms may apply to wholesale, business-to-business, personalised or specially commissioned orders.

Authorised seller and sales channels

These Terms apply where Girlevik Limited, trading as Toku LONDON, is identified as the seller and the order is processed through our official Shopify store, including orders placed through www.tokulondon.com, tokulondon.com, their Shopify-hosted checkout, or another channel expressly listed on this website as an Authorised Toku LONDON Sales Channel.

Purchases from third-party sellers, websites, marketplace accounts, social-media accounts or listings that are not operated by Girlevik Limited and do not meet the authorised-channel conditions above are not purchases from Girlevik Limited.

Customers should not provide payment details or personal information to a seller claiming to represent Toku LONDON unless Girlevik Limited, trading as Toku LONDON, is identified as the seller and the order is processed through our official Shopify store, or the channel is expressly listed as authorised on this website.

Nothing in this section limits any statutory rights or remedies, or any liability that cannot lawfully be excluded.

Orders placed through TikTok Shop or another marketplace may also be governed by that platform’s mandatory terms, deadlines, payment rules, returns procedures and dispute processes. Where a mandatory platform rule or applicable consumer law gives you greater rights, that rule or law will apply.

  1. ELIGIBILITY AND WEBSITE USE

You must be legally capable of entering into a binding contract to place an order. If you are under the age of legal capacity where you live, an order must be placed or authorised by a parent or legal guardian.

You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with the website’s operation, impersonate another person or use the website for unlawful or fraudulent activity.

  1. PRODUCT INFORMATION

We take reasonable care to describe and photograph our products accurately. Please read the full product description before ordering, including measurements, material, colour, quantity, bar thickness, bar length, fastening type and whether an item is sold singly or as a pair.

Images may be enlarged to show detail. Colours and apparent size can vary because of screen settings, lighting, photography and the device used. Small differences that do not make the item materially different from its description are not necessarily defects.

Measurements are approximate and minor manufacturing tolerances may occur. Jewellery fit varies between individuals. Customers are responsible for checking the stated dimensions and suitability before ordering.

We do not provide medical or professional piercing advice.

  1. JEWELLERY SAFETY AND SUITABILITY

Our jewellery is intended to be used only for its stated purpose. Customers should consider personal sensitivities, allergies, piercing condition, age, fit and professional advice before use.

Stop using an item if it causes unexpected pain, swelling, irritation or another adverse reaction and seek appropriate professional or medical advice where necessary.

Jewellery and small components can present a choking hazard. Keep them away from babies, young children and anyone unable to use them safely. Children’s jewellery must be selected and supervised by a responsible adult.

Nothing on our website is medical advice.

  1. HYGIENE-SEALED GOODS

Pierced earrings and body jewellery may be supplied in tamper-evident, heat-sealed hygiene packaging.

Opening, cutting, tearing, damaging or tampering with the seal may remove the right to return the item merely because you changed your mind, where the hygiene exception is permitted by law.

Please check the product description, measurements, colour, quantity and whether the item is sold singly or as a pair before ordering and before opening hygiene-sealed packaging.

This does not affect mandatory rights where an item is faulty, damaged on arrival, incorrect or materially not as described. Full details are set out in our Returns, Refunds and Hygiene-Sealed Jewellery Policy.

  1. PRICES, TAXES AND DELIVERY CHARGES

Prices are shown in the currency selected or displayed by the website. The total price, available delivery options and delivery charges will be shown before payment.

Where UK VAT applies, displayed consumer prices include VAT unless clearly stated otherwise.

For international orders, import VAT, customs duty, brokerage, handling charges or local taxes may be payable by the recipient unless checkout expressly states that they are included. These charges are imposed by foreign authorities or carriers and are not controlled by us.

  1. PLACING AN ORDER

The website allows you to review and correct order information before payment. Please check the products, quantities, size or variation, delivery address, delivery method and total price carefully.

By selecting the final payment or order button, you confirm that the order requires payment and that the information supplied is complete and accurate.

After an order is submitted, you may receive an acknowledgement. An acknowledgement confirms receipt of the order but does not necessarily mean that we have accepted it.

  1. ORDER ACCEPTANCE AND CONTRACT FORMATION

A contract is formed when we send an order confirmation indicating acceptance or when we dispatch the goods, whichever happens first.

We may decline or cancel an order before acceptance for a legitimate reason, including:

The product is unavailable.

Payment is not authorised or cannot be verified.

The delivery destination cannot be served.

An obvious and genuine pricing or description error has occurred.

We reasonably suspect fraud, unauthorised payment, resale abuse or unlawful activity.

The order breaches reasonable quantity restrictions, platform rules or applicable law.

If we cancel an order after taking payment, we will refund the amount paid for the cancelled goods and any associated delivery charge that must legally be refunded.

  1. AVAILABILITY AND QUANTITY LIMITS

Products are subject to availability. Stock information can occasionally be incorrect because of simultaneous purchases, inventory updates, damage found during packing or technical errors.

We may apply reasonable quantity limits to protect stock availability, prevent fraud or restrict unauthorised commercial resale.

If a limit affects an order, we will notify you and refund any amount paid for goods we do not supply.

  1. PAYMENT

Available payment methods are shown at checkout. Payments may be processed by Shopify Payments, card networks, digital-wallet providers or other payment providers. Their separate terms and privacy notices may apply.

You confirm that you are authorised to use the selected payment method and that the payment and billing information supplied is accurate.

We may use lawful fraud-prevention and payment-verification measures. This can include delaying dispatch while a payment or identity concern is reasonably checked.

We will not ask you to send full card details by ordinary email.

  1. PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes are subject to their stated conditions, availability and expiry dates.

Unless stated otherwise, discount codes cannot be exchanged for cash, applied retrospectively or combined with another promotion.

We may reject or cancel the use of a promotion where it has expired, does not meet its conditions, has been obtained or used fraudulently, or results from an obvious technical or publishing error.

  1. DELIVERY

Order processing, delivery estimates, tracking, international customs, incorrect addresses, delayed parcels, lost parcels and returned-to-sender orders are covered by our Shipping and Delivery Policy.

Orders are normally prepared within 1–3 working days, excluding Saturdays, Sundays and public holidays in England. Processing time is separate from delivery time.

Unless a different delivery period is agreed, we will deliver within the period required by applicable consumer law.

  1. OWNERSHIP AND RISK

For consumer orders, responsibility for loss or damage passes as required by applicable law, generally when the goods are delivered to you or to a person or place that you have specifically authorised.

Ownership of the goods passes after we have received payment in full and the goods have been delivered, unless applicable law requires otherwise.

  1. CANCELLATION, RETURNS AND REFUNDS

Your cancellation, return, hygiene-seal and refund rights are explained in our Returns, Refunds and Hygiene-Sealed Jewellery Policy.

For eligible change-of-mind returns, customers are responsible for return postage unless mandatory law provides otherwise.

Opened hygiene-sealed pierced earrings and body jewellery cannot normally be returned merely because of preference, colour, size or suitability.

Claims concerning faulty, damaged, incorrect or materially misdescribed goods may require reasonable photographs, video, packaging information or return of the item for inspection.

Requests for evidence do not remove any mandatory legal right.

  1. PRODUCT CARE, MISUSE AND ACCIDENTAL DAMAGE

Jewellery should be handled with reasonable care.

Damage caused after delivery by bending, twisting, pulling, forcing, over-tightening, incorrect fitting or removal, use of tools, alteration, attempted repair, impact, crushing, chemicals, perfumes, cosmetics, cleaning products, moisture or failure to follow reasonable care instructions is not normally a manufacturing fault unless the evidence shows an underlying defect.

Ordinary wear and tear, loss of detachable components after delivery and changes caused by personal use are not manufacturing faults.

We may inspect a returned item before deciding whether a product issue is confirmed.

  1. STATUTORY RIGHTS

Goods supplied to consumers must meet the standards required by applicable law.

In the United Kingdom, this includes requirements that goods are as described, of satisfactory quality and fit for any particular purpose made known to us where the law applies.

Nothing in these terms or another Toku LONDON policy excludes, restricts or replaces a right or remedy that cannot lawfully be excluded or restricted.

  1. OUR RESPONSIBILITY TO YOU

We are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill, subject to applicable law.

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or mandatory liability for faulty or misdescribed goods.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses caused solely by inaccurate information, misuse or unlawful conduct by the customer.

Goods sold to consumers are supplied for private use. We are not normally responsible for business losses such as loss of profit, revenue, contracts, opportunity or business interruption arising from consumer use, except where liability cannot lawfully be excluded.

  1. EVENTS OUTSIDE OUR REASONABLE CONTROL

We are not responsible for delay or failure caused by events outside our reasonable control, such as severe weather, postal or carrier disruption, customs delays, transport interruption, industrial action, government action, widespread technical failure or similar events.

We will take reasonable steps required by law and will contact you where a material delay becomes known to us.

This section does not remove a mandatory right to cancel, receive a refund or obtain another remedy.

  1. ACCOUNTS AND CUSTOMER INFORMATION

You are responsible for keeping account credentials secure and for promptly updating your contact and delivery information.

Tell us promptly if you believe that an account has been accessed without permission.

We process personal information in accordance with our Privacy Notice and Cookie Policy. Payment information is handled by the relevant payment service providers.

  1. REVIEWS, MESSAGES AND USER CONTENT

If you submit a review, photograph, comment or other content, you confirm that it is accurate to the best of your knowledge, relates to your genuine experience and does not infringe another person’s rights or contain unlawful, threatening, discriminatory, defamatory, malicious or deceptive material.

You retain ownership of your content.

You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and use content that you deliberately submit for publication in connection with our website, products and reasonable marketing, subject to applicable privacy and consumer law.

We may moderate or remove content where reasonably necessary to comply with law, protect rights, prevent fraud or enforce platform rules.

We will not suppress a genuine negative review merely because it is unfavourable.

  1. INTELLECTUAL PROPERTY

The Toku LONDON name, website design, text, graphics, product photography and other original content are owned by or licensed to Girlevik Limited unless stated otherwise.

You may use the website for personal shopping and information.

You must not copy, reproduce, commercially exploit, republish or distribute protected content without permission, except where law permits.

  1. THIRD-PARTY SERVICES AND LINKS

The website may use or link to services operated by third parties, including Shopify, payment providers, carriers, social platforms and analytics or advertising providers.

We are not responsible for the independent content or operation of a third-party website that we do not control.

Your use of a third-party service may be governed by that provider’s own terms and privacy notice.

This does not remove our responsibility for obligations that remain ours under applicable law.

  1. CHANGES TO THESE TERMS

We may update these terms for future orders to reflect changes in law, our business, services, technology or operating practices.

The version presented when an order is placed will normally apply to that order.

We will not use a later change to remove rights already acquired under an accepted order.

Material changes will be published with an updated date and any additional notice required by law.

  1. SEVERABILITY AND WAIVER

If a court or competent authority finds part of these terms unlawful or unenforceable, the remaining parts will continue to apply so far as legally possible.

If we do not immediately enforce a term, this does not permanently waive our right to enforce it later.

  1. GOVERNING LAW AND DISPUTES

These terms and contracts made through tokulondon.com are governed by the law of England and Wales.

If you are a consumer living outside England and Wales, you retain any mandatory protections and rights to bring proceedings in the courts available to you under the law that applies where you live.

Nothing in this section prevents either party from using a court, regulator, marketplace dispute process or another remedy available under applicable law.
